Organic Pastures E. Coli Lawsuit
In 2006, Organic Pastures, the leading raw milk dairy in California, became the epicenter of an E. coli outbreak that sickened at least six children. Two of the victims developed the hemolytic uremic syndrome that caused them to suffer acute kidney failure. In addition, one child experienced congestive heart failure, seizures and pancreatitis as a result of E. coli food poisoning. In order to hold Organic Pastures responsible for the suffering of their children, parents of several victims filed personal injury lawsuits against the company.
Organic Pastures E. coli Outbreak
In September 2006, six E. coli food poisoning cases were reported in California and Washington State. All of the victims were children who had consumed Organic Pastures raw milk products within days of becoming sick. The children experienced a range of severe gastrointestinal symptoms, including unrelenting diarrhea, fever, abdominal cramps and vomiting. Two of the infected children, 11-year-old Lauren Herzog and 9-year-old Chris Martin, developed hemolytic uremic syndrome, a condition whereby dangerous toxins produced by the E. coli bacteria enter the bloodstream and destroy the red blood cells. As the dead blood cells are filtered through the kidneys, the tiny blood vessels in the kidneys become blocked, leading to acute kidney failure. To treat this condition, both children had to undergo extensive dialysis treatments.
Sadly, Chris’s condition deteriorated and he also suffered a congestive heart failure, painful seizures and pancreatitis. To treat these complications, the boy required several blood transfusions and other emergency treatments. After his discharge from the hospital, the child’s parents were left with $450,000 in medical bills.
E. coli Food Poisoning Legal Recourse
In order to obtain compensation for their medical expenses, physical suffering and intense emotional distress, parents of several victims filed personal injury lawsuits against Organic Pastures. The lawsuits allege that Organic Pastures acted negligently in failing to provide its customers with reasonably safe products and thus exposing them to grave health dangers. If the company is found to be liable, it might be compelled to provide substantial compensation.
In addition to personal injury lawsuits, a civil suit has been filed against Organic Pastures by the U.S. Department of Justice on behalf of the Food and Drug Administration. This lawsuit seeks to prevent Organic Pastures from shipping its products across state borders, as well as to forbid the company from making claims about the benefits of raw milk on its website.
