AirTag Stalking Lawsuit
Did You Find an AirTag You Didn’t Put There?
AirTag stalking claims linked to unwanted tracking
AWKO is investigating claims involving Apple AirTag stalking, including cases where people were tracked without their knowledge or consent and Apple’s warning system allegedly failed to protect them. Apple has publicly stated that AirTag was designed to locate personal belongings, not people, while courts have already allowed certain AirTag stalking claims against Apple to move forward.
What Is AirTag Stalking?
AirTag stalking happens when someone uses an Apple AirTag to secretly track another person’s location. Victims may discover an AirTag in a vehicle, bag, or among their belongings, or receive an alert that an unknown AirTag is moving with them. These cases can involve emotional distress, fear, and invasion of privacy, especially when the tracking is prolonged or tied to domestic violence or harassment.
Why Claims Are Filed
Companies that design and sell tracking devices have a responsibility to reduce foreseeable misuse. Apple has faced allegations that it knew AirTags could be used for stalking and that its safeguards were built to “deter, not prevent” abuse, despite public marketing that emphasized anti-stalking protections. In March 2024, a federal judge allowed certain AirTag stalking claims to proceed, signaling that these allegations can move forward in court.
AirTag Reports and Safety Concerns
Apple has reported receiving more than 40,000 stalking reports involving AirTags, and plaintiffs have pointed to that history as evidence that misuse was foreseeable. Apple also announced updates to unwanted-tracking protections and said AirTag was not meant to track people, but critics argue the safeguards did not fully prevent abuse. Those concerns have helped fuel lawsuits alleging that Apple failed to do enough to stop unwanted tracking before harm occurred.
