3M (MMM) has been making headlines this year and for all the wrong reasons. The healthcare and consumer goods group, famous for its face masks, can no longer hide its troubled legal woes and it has now been denied a new trial, after a jury awarded a veteran Green Beret $50m (\u00a343bn) in his lawsuit against 3M.<\/p>\n

On 25 October, a Florida federal judge Roy B. Dalton Jr. rejected 3M’s motion for a new trial, alongside its alternative request for a remittitur, Judge Dalton disagreed with 3M\u2019s argument that veteran Luke Vilsmeyer’s injuries are mild and treatable.<\/p>\n

Judge Dalton stated that Vilsmeyer’s testimony was \u201cextremely effective and compelling\u201d and demonstrated the emotional impact that his tinnitus and hearing loss has had on his life.<\/p>\n

The ruling, however, failed to move 3M’s stock price on Tuesday \u2013 the day of the verdict. In fact, over the last week 3M shares rose by 8%.<\/p>\n

3M can’t mask its problems any longer<\/h2>\n

Meanwhile, the group’s third-quarter earnings were published on the day as the verdict. Indeed, the stronger-than-expected quarterly results saved the day for the 3M share price.<\/p>\n

Its profit more than doubled to $3.86bn, from $1.43bn for the same period last year. However, 3M adjusted its 2022 earnings target to between $10.10 to $10.35 per share, from its previous target of $10.30 to $10.80.<\/p>\n

But despite 3M\u2019s stock price surviving the latest ruling and its mixed earnings result, it is still not out of the woods.<\/p>\n

There are more than 230,000 lawsuits from veterans who complained about MMM Combat Arms Earplugs Version 2, which left many service members with tinnitus and hearing loss.<\/p>\n

Starting in 2018, the litigation came about after a whistle-blower filed a lawsuit against 3M revealing allegations that the company and its subsidiary Aearo Technologies had knowingly sold defective dual-ended Combat Arms earplugs to the US Military. This case resulted in a $9.1m (\u00a38m) settlement with the Department of Justice.<\/p>\n

On 20 May 2022, a jury in Pensacola, Florida ordered MMM to pay $77.5m to a US Army veteran named James Beal, who claimed he had suffered hearing damage due to the earplugs.<\/p>\n

3M then looked to put Aearo Technologies, the company that made the earplugs, into voluntary chapter 11 bankruptcy. This would allow Aearo a chance to settle the claims, while shielding 3M from a long and costly legal battle.<\/p>\n

Aearo Technologies announced on 26 July that it will be filing for bankruptcy protection, as it seeks to settle the lawsuits.<\/p>\n

But those plans were scuppered in August, when Judge Jeffrey Graham of the US Bankruptcy Court in Indianapolis ruled that the company would not get any protection against the lawsuits from the Aearo bankruptcy.<\/p>\n

\u201cWe are disappointed in the court\u2019s ruling today and will be filing an appeal. Further litigation in the multi-district litigation court benefits no one,” 3M said in a statement.<\/p>\n

3M (MMM) still has a high dividend yield<\/h2>\n

On Thursday 13 October it was announced that 3M had been given another chance to protect itself against the lawsuits. The federal appeals court in the US has agreed to hear 3M’s appeal following the legal defeat in August.<\/p>\n

Now the federal appeals court has granted 3M\u2019s request to review the bankruptcy judge\u2019s refusal to stop the mass lawsuits from proceeding, following the chapter 11 filing of its earplug manufacturing unit.<\/p>\n

Some experts believe that bankruptcy is coming next for 3M, however. Testifying before the court in August, corporate solvency expert J.B. Heaton said he believes the lawsuits could eventually force 3M into bankruptcy.<\/p>\n

\u201cIt is more and more likely within the next several years we\u2019ll see a 3M bankruptcy,\u201d Heaton said before the court, according to reporting from Bloomberg.<\/p>\n

Analysts believe that 3M\u2019s only hope is to settle these cases.<\/p>\n

\u201c3M (MMM) has every incentive to seek a settlement in that scenario. Litigating these cases is not a realistic scenario,\u201d Nigel Coe, an analyst at Wolfe Research said.<\/p>\n

So, just when 3M may be thinking it is finally in the clear, another curve ball is thrown. Alongside its veteran lawsuits, 3M announced in September that the group, alongside Wolverine World Wide (WWW), will pay $54m (\u00a349m) to Michigan property owners after a class action case was filed, claiming the companies were responsible for the release of PFAS chemicals into the environment in Kent County, Michigan.<\/p>\n

With that said, for investors there is still some good news, the company has a 4.71% annual dividend yield, which may lead many investors to stay put, see how the legal challenges go before running for the hills due to its growing lawsuits.<\/p>\n

A verdict has been reached in the first of many cases involving military members getting defective hearing protection.<\/p>\n\n\n\n

\u201cThere (are) 250,000 individual lawsuits filed at this point in the Northern District of Florida,\u201d said Bryan Aylstock from the Aylstock, Witkin, Kreis and Overholtz law firm in Pensacola. They are the firm that is taking the lead in all of these individual suits against 3M, the manufacturer of the Combat Arms version 2 ear plugs that were used by the military from 2002 to 2015.<\/p>\n\n\n\n

The plaintiffs in the cases are military members who have suffered hearing loss. The first of those cases has just ended with a verdict against 3M in federal court.<\/p>\n\n\n\n

\u201cSo, it was three soldiers, all of whom served this country honorably and used these Combat Arms earplugs and suffered hearing damage\" said Aylstock. \"Collectively they received a little bit more than $7.1 million, which is a tremendous verdict. A lot of that was punitive damages, where the jury found by clear and convincing evidence that 3M\u2019s conduct as it relates to these ear plugs was reprehensible and deserved to be punished. And also a message needed to be sent to others, including 3M, who might try to do this in the future, that this is not an acceptable way to conduct your business.\u201d<\/p>\n\n\n\n

This is the first lawsuit in what is called mass-tort litigation, which is different than a class-action suit, where all plaintiffs are represented in one law suit. There are two more already on the docket before Judge Casey Rodgers, Chief U.S. District Judge for the Northern District of Florida in Pensacola.<\/p>\n\n\n\n

\u201cThere\u2019s a panel called The Judicial Panel for Multi-District Litigation, and it determined a couple of years ago that Pensacola was the appropriate forum to conduct all of the pretrial activities for all of the cases of this nature.\u201d<\/p>\n\n\n\n

3M has already settled with the U.S.military for over $9 million, so the mass-tort litigation is only between the company and individual military members, both active duty and veterans. Aylstock fully expects this verdict to be appealed.<\/p>\n\n\n\n

\u201cIt will be appealed, and we feel confident that all of the pretrial rulings that Judge Rodgers made, and the trial rulings were appropriate, and the appellate court will also find that they were appropriate.\u201d<\/p>\n\n\n\n

Since the verdict there have been no talks of settlement with 3M, so the trials and appeals will continue. Aylstock says he doesn\u2019t know how many rulings for the plaintiffs would bring 3M to the settlement table. Said Aylstock, \u201cIt will be as many as it takes.\u201d<\/p>\n\n\n\n

The second trial is set to begin on Monday. <\/p>\n\n\n\n
